1. Who you're contracting with

Tivo AI is operated by GAPS ("we", "us", "our"). By creating an account or using the service you agree to these Terms.

2. The service

Tivo AI is a study aid for South African IEB students. It provides AI-powered homework explanations, practice tests, premade notes, study schedules, speech coaching, presentations, translation, and note summarisation. Tivo is a learning tool, not a substitute for a teacher, and its outputs may be inaccurate — always verify important answers.

3. Acceptable use

You must not:

• Use the service unlawfully or to commit fraud
• Infringe any intellectual property rights
• Submit content that is hateful, abusive, or sexually exploitative
• Probe, scrape, or attempt to disrupt the service or other users
• Submit other people's personal data without permission
• Use Tivo to submit AI-generated work as your own where your school's rules prohibit it — Tivo is for learning and drafting only

4. AI-generated content

You are responsible for your prompts, for how you use Tivo's outputs, for verifying accuracy, and for having the rights to any content you upload (including homework photos). We may remove or restrict content and refuse or filter outputs.

5. Intellectual property

The Tivo AI service, its software, branding, and documentation are owned by GAPS. You receive a limited, non-exclusive, non-transferable right to use the service on your selected plan. No reverse engineering or resale.

6. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. If you're under 18, a parent or guardian should agree to these Terms on your behalf.

7. Payment, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, cancellations, and refunds are governed by Paddle's Buyer Terms.

Subscriptions renew automatically until cancelled. Cancel anytime from your account or via paddle.net.

8. Service availability

We don't guarantee uninterrupted or error-free performance. Features may change. All implied warranties are disclaimed to the fullest extent permitted by law.

9. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security/fraud risk, or repeated policy violations. On termination, your data may be deleted after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you've paid in the prior 12 months. We exclude liability for indirect or consequential damages, loss of profits, data, or goodwill. We do not exclude liability for fraud, death, or personal injury where the law forbids it.

11. Governing law

These Terms are governed by the laws of South Africa.
